HC stays Sainik Cooperative Housing Society elections

JAMMU, Mar 20: In a petition filed by Capt Suraj Bhan and others challenging the holding of the elections to Managing Committee of the Sainik Cooperative Housing Society on various grounds, State High Court today issued notice to State through Commissioner Secretary, Cooperative Department, Registrar Cooperative Societies, Administrator Sainik Cooperative Housing Society and Kuldeep Raj, Returning Officer. In the meanwhile the High Court stayed the operation of the election notification dated February 12, 2013 till next date of hearing.
The petitioners have challenged the holding of elections to Managing Committee Sainik Cooperative Housing Society on the ground that Supreme Court of India has directed to review the rule relating to the elections within one month and hold elections thereafter within two months.
They further submitted that the elections cannot be held under the supervision of Administrator whose terms has expired.
After hearing the counsel for the petitioners, Justice Tashi Rabstan issued notice to the State and stayed the election notification.
