JAMMU, Aug 28: High Court has stayed the selection list of Assistant Professors in the Higher Education Department.
The stay was granted in a petition filed by Shahid Aziz, who through Advocate Rahil Raja submitted that in the Advertisement Notice No. Edu-Coll/adv/Acd/Arrg./JD/2017-18 dated 05.07.2017, the Administrative Department invited applications for engagement of Lecturers and Assistant Lectures in the Higher Education Department on academic appointment basis.
Qualification for the post of Lectures was provided as post-graduate degree in the concerned subject with minimum 55% marks (50% in case of Scheduled Caste, Scheduled Tribe and physically and visually handicapped candidates) along with NET/SLET/PhD) and that for the post of Assistant Lecturers post-graduate degree in the concerned subject with minimum 55% marks (50% in case of Scheduled Caste, Scheduled Tribe and physically and visually handicapped candidates).
He, however, submitted that no post of Assistant Lecturer is provided in the Jammu and Kashmir Education (Gazetted) College Services Recruitment Rules, 2008 and the department has started engagement process against non existence post of Assistant Lecturer in order to accommodate candidates, who do not possess NIT/SLET/PhD at the cost of the candidates, who possess the qualification like the petitioner.
After hearing counsel for the petitioner, Justice Janak Raj Kotwal issued notice to the respondents and directed that subject to objections from other side engagement process and the select list qua ‘Assistant Lecturers’ shall remain stayed.
