HC stays taking over of mgmt of Bawa Jitto Shrine by State

JAMMU, Dec 24: In a significant order, High Court has stayed the operation of Govt order No 413-TSM of 2013 dated October 4, 2013 whereby sanction was accorded for constitution of a board for management, administration and governing the affairs of Shri Bawa Jittoo Mal Shrine at Jhiri.
The stay order was passed in a petition filed by Vishnu Dutt and others wherein taking over of the management by the State Government was challenged.
After hearing Advocate Abhinav Sharma for the petitioners, Justice Dhiraj Singh Thakur observed, “the petitioners urge that the impugned Government order is in gross violation of rights of the petitioners as enshrined under Article 26 of Constitution of India which gives freedom to every religious denomination or a section of it, right to establish and maintain institutions for religious and charitable purposes and to manage in its own way all affairs in matters of religion”.
While staying the operation of the Govt order, the High Court also issued notices to the Commissioner Secretary Tourism and Culture Department, Additional Divisional Commissioner Jammu, Deputy Commissioner Jammu, SSP Jammu, SSP Traffic, Joint Director Tourism, Assistant Commissioner General Jammu, CMO Jammu, BDO Jammu and MLA Marh Constituency returnable within four weeks.
