HC stays termination of CLTCs experts

JAMMU, Oct 23: State High Court today stayed the termination of experts in City Level Technical Cell.
Advocate Abhinav Sharma appearing for the petitioners submitted that Vide Notification dated December 19, 2013 applications were invited for the contractual engagement of experts in City Level Technical Cell in the State under Rajiv Awas Yojna.
The engagement was to be for an initial period of two years, terminable by one month’s notice by J&K Housing Board, he said, adding pursuant to this notification petitioners came to be appointed on March 7, 2015 and it was mentioned in the order that the contractual assignment shall be for two years or conterminous with the scheme and no candidate shall claim regularization. However, all the petitioners have been terminated because of disbanding of CLTCs.
After hearing Advocate Abhinav Sharma in length, Justice Janak Raj Kotwal observed, “the impugned order whereby the petitioners have been terminated has been issued without assigning any reason or issuing notice to the petitioners and without giving them benefit of office memorandum dated March 8, 2015 issued by the Government which provides for utilizing their services in subsequently launched Housing for All Scheme”.
Accordingly, court issued notice to the State with the direction to file response within four weeks. In the meanwhile, subject to objections, the impugned order shall remain stayed.
