HC stays transfer, attachment of CEO Udhampur

JAMMU, May 13: High Court today kept in abeyance the Government order regarding transfer of Chief Education Officer Udhampur Balbir Singh and his attachment with Directorate of School Education Jammu.
The transfer order dated April 16, 2014 was challenged by Balbir Singh on the ground that the same was passed for mala-fide considerations.
Advocate W S Nargal, who was appearing for the petitioner, submitted before Justice Tashi Rabstan that the order was issued in flagrant violation of Model Code of Conduct and also the ban imposed by the School Education Department wherein the policy has been framed that no transfer/attachment of the teaching staff shall be made in Jammu province till further orders.
“The transfer order seems to have been issued by the Principal Secretary, School Education Department at the behest of Deputy Commissioner Udhampur, Yasha Mudgal for mala-fide considerations and that too on the basis of a complaint filed by one Tirath Ram, who happens to be the general secretary of Block Youth Congress, Ghordi”, he said, adding “the order of attachment of the petitioner is stigmatic and is an offshoot of a false and a frivolous complaint”.
Advocate Nargal further submitted that the allegations leveled against the petitioner were never verified nor the petitioner was given any opportunity of being heard.
After hearing counsel for the petitioner, Justice Tashi Rabstan issued notice to the respondents returnable within four weeks. Meanwhile, subject to objections from other side and till next date of hearing the impugned Government order shall remain in abeyance, Justice Rabstan directed.
The High Court also directed the official respondents to file status of the case on the next date of hearing.
