HC stays transfer of SHO

JAMMU, Nov 22: High Court today stayed the transfer of SHO Police Station Satwari Ghulam Hassan Kamal and issued notices to Commissioner Secretary Home, DIG Jammu and SSP Jammu.
Ghulam Hassan Kamal knocked the doors of the High Court challenging his transfer from Satwari Police Station on the ground that he was transferred four times in a week.
During the course of arguments, Senior Advocate BS Salathia said that as per the Police Rules, Superintendent of Police may post and transfer Sub Inspectors, ASI and all lower ranks in the district. Moreover, a register of posting of all enrolled police officers except Inspectors shall be maintained in English in the office of DIG.
“The order passed by SSP Jammu is in violation of Service Rules and has been passed for extraneous considerations and for the reasons best known to SSP”, he said.
After hearing the arguments in length, Justice Tashi Rabstan ordered that impugned order dated October 21, 2013 whereby SSP Jammu has transferred Gulam Hassan Kamal to District Police Lines and order dated September 27, 2013 whereby SSP Jammu has directed Inspector Arvind Singh to look after the work of SHO P/S Satwari till further orders shall remain stayed.
