JAMMU, Oct 24: High Court today stayed the transfer order of Administrative Officer in the Directorate of Family Welfare, MCH and Immunization Jammu and a Junior Engineer.
According to a petition, Sushil Kumar Sharma was transferred vide Government Order dated May 22, 2013 and posted as Administrative Officer in the Directorate of Family Welfare, MCH and Immunization Jammu against available vacancy.
However vide Govt order dated October 4, 2013 issued by Under Secretary H&ME, the petitioner has been deputed to National Rural Health Mission for further duties without specifying the post against which petitioner has been deputed. The grievances of the petitioner is that authority competent to transfer the petitioner is GAD and not the Health and Medical Education Department.
After hearing Advocate Rakesh Sharma appearing for the petitioner, Justice Janak Raj Kotwal issued notice to the respondents returnable within two weeks and in meanwhile stayed the operation of Govt order dated October 4, 2013 till next date.
Similarly, Justice J R Kotwal stayed the transfer of JE Satvinder Pal Singh from REW Jammu to PMGSY.
According to the petitioner, he was earlier deputed to REW Jammu from PHE. However, on October 11, 2013 Commissioner Secretary PWD without any authority and competence transferred him from REW to PMGSY Jammu.
