HC suspends sentence awarded to DEO

JAMMU, Apr 19: State High Court has suspended the sentence awarded to Mohd Yousaf Kohli, then District Education Officer, Poonch, who was convicted and awarded nine years imprisonment and fine of Rs 2,70,000 in nine corruption cases.
After hearing Senior Advocate Sunil Sethi with Advocate Waheed Choudhary appearing for the appellant whereas Advocate General MI Qadiri with Advocate Sarishti Pal Mengi appearing for the State respondents, Justice J P Singh admitted the appeal to hearing and issued notice to respondents.
“The appellant is stated to have been on dialysis when he was taken into custody pursuant to the order of sentence passed by Special Judge Anticorruption Jammu. The documents placed by the appellant reveal that he was under regular renal clinic follow up. Therefore, keeping in view the quantum of sentence awarded to appellant and the illness from which he has been suffering, it is considered appropriate to suspend his sentence during hearing in the appeal enabling him to have requisite medical treatment”, Justice J P Singh said.
With these observations, the High Court suspended the sentence awarded to him on April 16, 2012 and ordered that the petitioner be released on bail on depositing 50% of fine imposed by the Trial Court and furnishing of personal bonds and surety bonds in the amount of Rs 10,000 to the satisfaction of Special Judge Anticorruption Jammu.
