HC suspends sentence, grants bail to convicted Veterinary Doctor

JAMMU, Mar 9: High Court has suspended sentence and granted bail to Dr Manohar Lal, a Veterinary Doctor and his driver Jaswant Lal, who were convicted by Additional Sessions Judge Anti Corruption Jammu on March 1, 2019 for two years imprisonment.
Challenging the judgment passed by Additional Sessions Judge, Advocate AK Sawhney appearing for Veterinary Doctor submitted before the High Court that judgment passed is perverse and passed with non-application of mind. He referred to the statements of the witnesses which were totally contradictory and the so called trap team had itself not corroborated the evidence and testimonies.
After hearing submissions of Advocate A K Sawhney and Advocate Sanchit Verma vice Dy AG Raman Sharma, Justice Rashid Ali Dar observed, “the points raised in the memo of appeal are required to be examined after hearing of the parties and on receipt of the record”, adding “suffice to say that having regard to the plea raised in the memo of the appeal in particular and the plea of solemnization of the marriage raised at bar by counsel for the appellants/applicants, the ground is made out for suspension of sentence”.
Accordingly, subject to objections and till next date of hearing before the bench, Justice Dar suspended the sentence. “The appellants/applicants shall be released from the custody subject to the condition that they shall furnish bonds in an amount of Rs 1 lakh each with two sureties in the like amount to the satisfaction of the Registrar Judicial”, High Court directed.
