HC upholds appointment of Housekeeper by SSB

Srinagar, June 2: High Court has upheld the selection of a House Keeper by Service Selection Board under open merit category.
One Tariq Maqbool Bhat was selected as House keeper in terms of notification dated: 10.01.11 passed by Service Selection Board under open merit category thereafter his appointment order came to be issued vide order no. GDC/56 dated: 24.3.11 and  his selection was challenged by a non-selectee through writ petition on the ground that on information obtained via RTI, it has come to known that the certificates produced by Bhat were fake as such his appointment, the petitioner seeks be quashed and he (petitioner) be appointed on the said post.
Writ court has dismissed the plea of the petitioner with a view that the allegations of fake certificates produced by the respondent-Bhat have not been proved by the petitioner.
Aggrieved of the writ court’s dismissal order the petitioner challenged it before DB seeking reversal of the writ court judgment.
Counsel representing selected candidate advocate Asif Maqbool in support of his arguments submitted before the appellate court that it is wrong to say that his client (Tariq Maqbool) has submitted two different certificates and  “it is sheer merit that has prevailed on the basis of which his client stood selected and appointed”, Advocate Asif further submitted before the DB.
Court to ascertain the issue of fake and forged certificate called the records from the SSB and after perusal of records the court suggested the plea that the selectee has got fake and forged academic certificates loses force and is turned down.
“Having said that the benefit of selection and appointment of private respondent cannot be taken away from him only because a certificate that has been issued by an unrecognized Board is enclosed with the application form of the private respondent”, division bench of Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey said while upholding the writ court judgment and dismissing the appeal as meritless.
