JAMMU, Mar 11: In a significant Judgement, Justice Sanjeev Kumar of the Jammu & Kashmir and Ladakh High Court has upheld the judgment passed by the Court of Principal Sessions Judge, Rajouri, convicting Mohammad Jameel, a militant associated with Hizbul Mujahideen (HM).
Jameel was found guilty of offenses under Sections 3/25 and 7/25 of the Arms Act and sentenced accordingly.
The court affirmed Jameel’s conviction for possession of arms and ammunition, as well as his subsequent arrest by the Border Security Force (BSF) under the Special Powers Act, 1990.
Despite Jameel’s claims, the court determined that the recovery of arms and ammunition from his possession was lawfully executed and admissible as evidence.
Furthermore, Justice Sanjeev Kumar noted the absence of any substantial contradictions or discrepancies in the prosecution’s evidence, which solidified the trial court’s findings.
Jameel’s failure to provide a credible explanation during his examination under Section 342 of the CrPC further weakened his defense.
In light of these observations, the High Court, after hearing both the sides, dismissed Jameel’s appeal, emphasizing the trial court’s sound reliance on the evidence presented.
Consequently, Jameel’s bail bonds, previously granted by the High Court, have been forfeited, and he is asked to surrender to the authorities to serve the remainder of his sentence.
