JAMMU, May 24: High Court has upheld the detention under Public Safety Act of Farooq Ahmad Misgar, who was working as an Assistant Cashier in the J&K Bank Shalimar Branch, Srinagar and affiliated with TRF.
“The petitioner is working as a Cashier in the J&K Bank and, therefore, cannot claim that he is either illiterate or unable to understand the language in which the order of detention and the grounds of detention were couched obviating the necessity of furnishing a translated version of the documents in any other language”, Justice Dhiraj Singh Thakur said, adding “insofar as the legal obligation to read over the detention order and the grounds of detention to the detenue is concerned, has been fully satisfied.
Accordingly, High Court dismissed the petition and upheld the order passed by the District Magistrate, Srinagar, who, in purported exercise of its powers vested in it under Section 8 of the Jammu and Kashmir Public Safety Act, 1978 has ordered the detention of the petitioner with a view to prevent him from acting in any manner prejudicial to the maintenance and security of the State.
