HC upholds PSA of narco smuggler

JAMMU, Jan 3: High Court has upheld the preventive detention of one Fida Hussain Bhat ordered by the Divisional Commissioner, Kashmir in exercise of the powers vested in him under Section 3 of the J&K Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988.
As per the detention order, the detenue is a habitual indulgent in the trade of narcotics and psychotropic substances and was involved in a case FIR No 171/2018 under Section 8/20 NDPS Act registered at Police Station Qazigund.
On 26-07-2018, he along with associates was arrested for smuggling brown sugar and accordingly charge sheet was produced before the competent court of law on 13.09.2018. The detenue was bailed out in this FIR but he repeated the same act and did not desist from indulging in illegal trade of narcotic drugs and psychotropic substances.
The detaining authority after arriving at a satisfaction that the detenue is an incorrigible drug peddler, operating in an organised and well-planned manner and thereby posing serious threat to the life and health of the people particularly younger generation passed order of detention.
While dismissing the petition filed by Fida Hussain Bhat, Justice Ali Mohammad Magrey observed, “the detention survives even if one of the grounds taken in support of the petition remains unexplained or proves to be bad in law”, adding “detention order can be maintained in absence of any explanation on this count by the respondents”.
