HC upholds PSA of notorious criminal

JAMMU, Dec 8: High Court has upheld the PSA of Yudvir Singh, a notorious criminal who was also involved in firing at Choudhary Nagar Singh’ house.
After hearing Advocate Jagpaul Singh for the detenue whereas AAG Aseem Sawhney for the UT, Justice Tashi Rabstan observed, “J&K Public Safety Act, 1978 is designed to prevent all those acts that are prejudicial to security of the state or maintenance of public order”, adding “the acts, indulged in by persons, who act in concert with other persons and quite often such activity has national level ramifications. These acts are preceded by a good amount of planning and organisation by the set of people fascinated in tumultuousness. They are not like ordinary law and order crimes”.
“In the present case the petitioner has been involved in many criminal activities and against him sixteen FIRs have been lodged under various sections of the IPC in different police stations. Therefore, it seems the petitioner is a hardcore criminal, has become a terror figure among the people of the area and the actions taken against him under the ordinary law from time to time have not been proved to be deterrent”, the High Court said.
“The record so produced reveals that the petitioner-detenue has been indulging in illegal trade in an organized manner, which is a great threat for sustaining the conservative values of the society and that drug trafficking also possess great threat to the society for the reason that the proceeds of the drug sale can be utilized for financing of other criminal activities”, the High Court said.
