SRINAGAR, Jan 8: High Court upheld the detention order of an Over Ground Worker (OGW) passed under Public Safety Act (PSA) and dismissed his plea challenging the same in a petition.
Shahid Maqbool Bhat of district Pulwama had challenged his detention order by way of habeas corpus petition contending therein that the impugned order of detention has been issued by the District Magistrate Pulwama is without application of mind as the allegations mentioned in the grounds of detention have no nexus with him and that the same have been fabricated by the police in order to justify its illegal action of detaining him.
Bhat was detained under detention order dated 04.08.2023 has been placed under preventive detention with a view to prevent him from acting in any manner prejudicial to the security of the State. Justice Sanjay Dhar while dismissing his plea and upholding the order of detention said the grounds of detention clearly reveal that there are specific allegations against the petitioner-Bhat about his nexus with the Pak handlers as the names of those Pak handlers, with whom he has been allegedly in constant touch, have clearly been mentioned in the grounds of detention and even the names of radical elements with whom he had a chance to meet, are mentioned therein.
“The detaining authority, after culling out necessary facts from the police dossier, has clearly recorded its satisfaction that the activities of the petitioner are highly prejudicial to the security of the State. The grounds of detention framed by the detaining authority exhibit application of mind on its part and it cannot be stated that the same are mere reproduction of the dossier”, Justice Dhar mentioned in the judgment and dismissed the petition with the conclusion that there is no ground to interfere with the impugned order of detention.
