Srinagar, Nov 25: High Court has warned the personal appearance of Commissioner Srinagar Municipal Corporation in case compliance is not filed in tune with the judgment passed three years ago.
Justice Wasim Sadiq Nargal said that prima facie, the Commissioner SMC, Joint Commissioner (Works) SMC and Executive Engineer are in recurring contempt for which they are liable to be proceeded against.
The court, however, before proceeding against these officials granted the last and final opportunity of one week to them to comply with the judgment of the court. “…failing which Commissioner SMC shall appear in person before this court on the next date of hearing”, Justice Nargal clarified.
The court was dealing with a contempt petition filed way back in the year 2021 seeking implementation of basic judgment passed in October 2021 and till date, the SMC-officials have not chosen to file any compliance report in the instant case.
Compliance report stands filed on behalf of Commissioner Secretary PWD and Chief Engineer PWD and along with compliance report, the Commissioner Secretary has also placed on record a communication dated 5th November, 2024, issued by the Law Officer, Public Works (R&B) Department, to the Commissioner, Srinagar Municipal Corporation, Srinagar, whereby it has been conveyed to the Commissioner, Srinagar Municipal Corporation, that the instant contempt petition pertains to Srinagar Municipal Corporation and that there is no role of Public Works (R&B) Department in the instant case and accordingly, a request has been made to the Commissioner, Srinagar Municipal Corporation, to comply the basic judgment.
The court said that in spite of issuance of the communication and also in the light of the fact that the instant contempt petition is pending before this Court since 2021, the SMC-officials have not bothered to file any compliance report and the judgment passed by this Court has not been complied with by the respondents till date.
The authorities in terms of the basic judgment were directed to release the retained amount of 10 percent to the contractor within a period of six weeks for the construction of a walkway in Srinagar city which he has completed already.
