HC’s directive on promotion of Constable Operators

JAMMU, Feb 21: High Court has directed the State to consider and decide the representations of the petitioners against impugned seniority list of Constable Operators of 1998 batch before making promotions.
After going through the petition and hearing Advocate Pawan Kumar Kundal appearing for the petitioners, Justice Dhiraj Singh Thakur observed, “dispute in the present petition pertains to the manner in which the seniority list of Constable Operators of 1998 batch is prepared”, adding “it is stated that the seniority has not been prepared in accordance with the Rules and in particular Rule 111 of the Police Rules”.
“It is also stated that the respondents are likely to make promotions on the basis of the impugned seniority list without considering the representations filed by the petitioners before the respondents”, High Court further said.
Justice Thakur ordered that subject to objections, the respondents shall consider and decide the representations of the petitioners against impugned seniority list before any such promotions are made.
“The promotions if any made after the consideration of the representations of the petitioners shall remain subject to outcome of the present writ petition”, Justice Thakur further ordered.
