Husband acquitted in alleged murder of wife

JAMMU, May 27: Principal Sessions Judge Ramban Mohd Akram Chowdhary today acquitted one Manzoor Ahmed, who was facing trial for murdering his wife as eye-witness (son of deceased and accused) didn’t support the prosecution story.
According to police case, on October 1, 2008 one Saif Ullah Mir, son of Mohd Mir of Dulligam, lodged a complaint mentioning that his daughter Zubera Begam was beaten with the help of Dharat by her husband and even forced to drink poisonous substance which resulted into her death.
On this, police registered a case under Section 302 RPC and after completion of investigation challan was presented in the court of law.
After hearing both the sides, Principal Sessions Judge Ramban observed, “though there is admitted evidence of the complainant but the same is also on hearsay as narrated by prosecution witness Sahil Manzoor the so called eye witness who has himself resiled from the prosecution story”.
“There is no direct or circumstantial evidence to connect the accused with the commission of offence except the expert evidence of the doctor conducting postmortem and the Forensic Expert. Even if the expert evidence is accepted to the extent that the deceased had died of poisoning as detected in the viscera of the deceased, there is no evidence that the deceased’s wife had been administered poison by the accused since the edifice of the evidence has been completely demolished by the only eye witness Sahil Manzoor, son of the deceased and the accused, who denied the contents of the statement attributed to him recorded during investigation”, the Court said.
“In this backdrop of the matter, it is held that the prosecution has not succeeded by leading conclusive evidence to bring home the charge against the accused”, the Court said and acquitted the accused of the charges leveled against him.
