When confession comes from the Law and Justice that police investigation in criminal cases is faulty and flawed, it carries a strong message that justice is not done. The impression it gives is that the government intentionally wants to make investigation become imperfect. Even the High Court has in many cases asked the government to streamline the entire process of investigation. This observation was made when known criminals walked free because the State was not able to prove their involvement. From what the Law and Justice Minister said while reviewing the performance of the prosecution wing of JK Police in Jammu Division, it is evident that justice becomes elusive.
The need is to bring about necessary reforms in investigation part of criminal process. Investigating authority should be well trained and professionally perfect in the nature of duty. Next is to use modern and more scientific methodology of investigation. We need upgraded forensic laboratories where tests are made and inferences arrived at. We are not aware whether such laboratories have been provided or not. The fact is that the quality of justice is severely handicapped in the face of flawed investigation. If known criminals walk out free from the grips of the law, the impression going out is that corruption is galore in the ranks of society. That is a very damaging thing and should be avoided. The onus is on the doorsteps of the police which must do all it can with the cooperation of entire governing machinery to remove any such negative impressions from the minds of the people about their role in investigating criminal cases.
