SRINAGAR, Oct 8: High Court of Jammu & Kashmir and Ladakh has held the employees of the J&K Project Construction Corporation (JKPCC) entitled to payment of gratuity in terms of the provisions contained in Section 4 of the Payment of Gratuity Act, 1972 retrospectively notwithstanding anything contained in Rule 5(ii) of the J&K PCC Gratuity Rules.
While disposing of writ petition filed by Project Construction Corporation Workers Association, Justice Sanjay Dhar directed the respondent-Corporation to examine the individual cases of its employees who have already received gratuity by application of Rule 5(ii) of the J&KPCC Gratuity Rules and take follow up action in the light of latest direction if and when such instances are brought to its notice by the aggrieved employee or his/her legal heirs.
