JMIC RS Pura orders inquiry into arrest

JAMMU, Dec 28: Judicial Magistrate Ist Class, RS Pura, MI Khan has asked the SSP Jammu to hold an inquiry into the arrest of Kuldeep Kumar by a police team other than RS Pura, where he was arrested in FIR No. 129/2013 under Sections 447, 427 and 147 RPC read with Section 4/25 Indian Arms Act.
Mr Khan passed the direction after summoning the Tehsildar and Naib Tehsildar RS Pura, who were reported to have given police remand of Kuldeep Kumar.
The Tehsildar and the Naib Tehsildar have already deposed before the Judicial Magistrate and gave their clarification on the police remand of Kuldeep Kumar. The Judicial Magistrate has now summoned RS Pura police station’s Investigating Officer Anwar Ali on December 30 to give his point of view in the case.
Mr Khan had made Robkar against Anwar Ali and Tehsildar RS Pura in the case.
The JMIC RS Pura had also directed the Block Medical Officer (BMO), RS Pura for medical examination of Kuldeep Kumar son of Kartar Chand thoroughly as he had submitted in his complaint that he was forced to drink human urine in the custody of RS Pura police.
In the Robkar against Anwar Ali, Mr Khan had taken exception that he had produced Kuldeep Kumar before the Tehsildar RS Pura instead of Judicial Magistrate First Class by superceding settled proposition of law.
In the Robkar against the Tehsildar RS Pura, Mr Khan said he had remanded Kuldeep Kumar to police custody despite having no power to grant the remand as per the settled law.
