MHA yet to take decision on separate feeder cadres
*Promotions to be ordered in terms of combined seniority/strength

JAMMU, Dec 21: There will be Joint Services/Cadres of Jammu and Kashmir Administrative Service, Jammu and Kashmir Police Gazetted Service and Jammu and Kashmir Forest Gazetted Service for the Union Territory of Jammu and Kashmir and Union Territory of Ladakh as Ministry of Home Affairs has yet not taken any decision on separate feeder cadres for the cold desert region.
A notification in this regard has been issued on the instructions of Union Ministry of Home Affairs and by the orders of Lieutenant Governor of Union Territory of Jammu and Kashmir Manoj Sinha in consultation with the administration of the Union Territory of Ladakh.
The notification has been issued in exercise of the powers conferred under proviso to Article 309 of the Constitution of India read with Section 89 of the Jammu and Kashmir Reorganization Act, 2019 by the General Administration Department.
“Lieutenant Governor has directed that there shall be Joint Services/Cadres of Jammu and Kashmir Administrative Service (JKAS), Jammu and Kashmir Police Gazetted Service (JKPS) and Jammu and Kashmir Forest Gazetted Service (JKFS) for the Union Territory of Jammu and Kashmir and Union Territory of Ladakh pending final decision regarding separate feeder cadres for the respective services in the Union Territory of Ladakh by the competent authority”, read the notification.
Further, it has been mentioned that promotion of the members of these services will be effected in terms of the combined seniority/strength of the services against the total posts of these cadres allocated to the Union Territory of Jammu and Kashmir and Union Territory of Ladakh.
“The decision will not only bring an end to the confusion prevailing among the officials of these three services but will also ensure smooth functioning of the Union Territory of Ladakh till its gets its own cadres”, sources said.
Disclosing that discussions are going in the Ministry of Home Affairs on separate feeder cadres for the respective services in the Union Territory of Ladakh, sources, however, expressed inability about the time-frame within which the Ministry will take decision although the UT of Ladakh is raising demand for the same ever since the bifurcation of the then State of Jammu and Kashmir.
Section 89 of the Jammu and Kashmir Reorganisation Act 2019 read: “Every person who immediately before the appointed day is serving on substantive basis in connection with the affairs of the existing State of Jammu and Kashmir shall, on and from that day provisionally continue to serve in connection with the affairs of the Union Territory of Jammu and Kashmir and Union Territory of Ladakh, by general or special order of the Lieutenant Governor of Union Territory of Jammu and Kashmir”.
Every direction under Sub-Section 1 of Section 89 issued after the expiry of a period of one year from the appointed day shall be issued with the consultation of the Government or Administration of the successor Union Territories.
“As soon as may be after the appointed day, the Lieutenant Governor of Jammu and Kashmir shall, by general or special order, determine the successor Union Territory to which every person referred to in Sub-Section (1) shall be finally allotted for service, after consideration of option received by seeking option from the employees, and the date with effect from which such allotment shall take effect or be deemed to have taken effect”, the proviso of Section 89 states:
Further, even after the allocation has been made, Lieutenant Governor of Union Territory of Jammu and Kashmir may in order to meet any deficiency in the service, depute officers from one successor Union Territory to the other Union Territory.
And every person who is finally allotted to a successor Union Territory shall, if he or she is not already serving therein, be made available for serving in the successor Union Territory from such date as may be agreed upon between the Government of the successor Union Territory of Jammu and Kashmir and Administration of Union Territory of Ladakh, or, in default of such agreement, as may be determined by the Central Government.
