SRINAGAR, Aug 23: Under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of Judges, State Judicial Academy (Justice Muzaffar Hussain Attar, Chairman, Justice Hasnain Massodi, Member and Justice Janak Raj Kotwal, Member), Jammu and Kashmir State Judicial Academy today conducted one day refresher course on “Examination of Witnesses” and “Moot Court including order writing with regard to examination of witnesses” for all Munsiffs of Kashmir province.
Abdul Rashid Malik, District and Sessions Judge, Pulwama and Pawan Dev Kotwal, Director, State Judicial Academy were the resource persons.
The proceedings were conducted by Pawan Dev Kotwal, Director, State Judicial Academy. In his introductory remarks, he deliberated on the need for such refresher programmes for the Judicial Officers.
A moot/mock court was held in which young Judicial Officers participated as Presiding Officers, Prosecutor, Defence counsel and witnesses. After the examination of witnesses in the mock court, an interactive session was held on the role and conduct of Judicial Officer while examining witnesses. Participating officers raised queries on procedure and various provisions of Evidence Act which were answered by the resource persons to their satisfaction. The participating officers also interacted and raised some practical problems being faced by the trial courts in implementing/applying the legal provisions in dispensation of justice in general and examination of witnesses in particular. The problems were discussed and solutions were suggested by the resource persons which were taken by the participating officers as their course of action in future.
