Chief Secy to take call on action taken by deptts in RDAs
New entries inserted for smooth transaction of business

JAMMU, Mar 10: Lieutenant Governor of Union Territory of Jammu and Kashmir Manoj Sinha has delegated more powers to the Chief Secretary in respect of matters related to appointment of non-gazetted staff in nine important departments, referral of vacancies to the recruiting agency and acceptance of Regular Departmental Actions (RDAs) against the officials.
This has been done in exercise of the powers conferred by President Order S.O No.3937 (E) dated October 31, 2019 read with the Third Proviso to Rule 7 and with Rule 43 of the Transaction of Business of Government of Union Territory of Jammu and Kashmir Rules, 2019 and in continuation of Government Order No.810-JK(GAD) dated September 1, 2020.
In exercise of the powers conferred by Section 55 of the Jammu and Kashmir Reorganization Act, 2019 read with Proclamation dated October 31, 2019 issued under Section 73 of the Act, the President of India had in the month of August last year framed Transaction of Business of the Government of Union Territory of Jammu and Kashmir Rules and the same were notified by the Union Ministry of Home Affairs.
Third Proviso to Rule 7 of these Rules states that in case of Proclamation under Section 73 of the J&K Reorganization Act, 2019 is in force, the Lieutenant Governor shall determine the manner in which proposals are to be disposed off.
Similarly, the Rule 43 states: “The Lieutenant Governor may by standing orders in writing, regulate the transaction and disposal of the business relating to his executive functions provided that the standing orders shall be in consistent with the instructions issued by the Central Government from time to time”.
In the previous order, it was mentioned that the Chief Secretary will exercise the powers of the Minister in respect of appointment of non-gazetted staff of the Jammu and Kashmir Secretariat (Subordinate) Service on the recommendations of the Jammu and Kashmir Services Selection Board.
Now, the Chief Secretary has been given powers in respect of appointment of non-gazetted staff on the recommendations of the Jammu and Kashmir Services Selection Board in General Administration Department, Housing and Urban Development Department, Information Technology Department, Science and Technology Department, Law, Justice and Parliamentary Affairs Department, Estates Department, Forest, Ecology and Environment Department, Information Department and Mining Department.
Moreover, on the directions of the Lieutenant Governor several new entries have been added after Entry No.1(M) of the Government Order dated September 1, 2020 which pertains to delegation of powers.
Accordingly, the Chief Secretary has been given powers of the Minister vis-a-vis grant of approval to referral of vacancies to the Jammu and Kashmir Public Service Commission and Services Selection Board as the case may be.
Moreover, powers for acceptance of action taken by the Administrative Departments in Regular Departmental Actions initiated on the recommendations of the Anti-Corruption Bureau have been delegated to the Chief Secretary. However, in cases where the action taken is not found appropriate, such cases will be placed for the consideration of the Lieutenant Governor.
The Chief Secretary will also accord approval to the cases of diversion of forest and wildlife land for the developmental projects for submission on the PARVESH portal of the Union Ministry of Environment and Forests. Even powers related to sanction of Leave Travel Concession (LTC) have been given to the Chief Secretary by the Lieutenant Governor.
It is pertinent to mention here that the Chief Secretary has already been given several powers vis-a-vis financial matters, transfers and postings/adjustments, deputations, grant of relaxations under the Jammu and Kashmir Civil Services (Medical Attendance-cum-Allowance) Rules, 1990, accord of approval to the Recruitment Rules and sanction all types of leave of officers of the level of Secretaries and above.
Similarly, several Administrative Secretaries have been given many powers of the Minister in order to ensure smooth transaction of Government business in the Union Territory of Jammu and Kashmir.
