Life-imprisonment awarded in murder of Dabur India employee

JAMMU, July 28: Principal Sessions Judge Samba Sonia Gupta today awarded life-imprisonment to Kaleshwar Hondsa, an employee of Dabur India, who murdered his senior Suresh Chander Sharma.
On November 1, 2012, S K Sabapathy, son of K S Sundram, Unit Manager of Dabur India Ltd, made a written complaint to SHO Police Station Bari Brahmana mentioning that one worker namely Kaleshwar Hondsa, son of Chund Hondsa of Jharkhand has killed Suresh Chander Sharma, son of R K Sharma of Rajasthan.
Accordingly, case was registered at Police Station Bari Brahmana for the commission of offences punishable under Sections 302/307 RPC and investigation started.
After hearing Public Prosecutor Jawaid Ahmed Khawaja, the court observed, “convict Kaleshwar Hodsa is a young person and the imposition of sentence for life imprisonment would serve the interest of justice and that the present case does not fall in the category of rarest of rare case so as to the imposition of death sentence, which is of exceptional nature”.
“Keeping in view the age of the convict/accused and considering the contention of Amicus Curaie about the crime, I think this case does not fall in the category of rarest of rare case”, the Judge said and awarded imprisonment for life and a fine of Rs 10,000 for offence under Section 302 RPC and in default of payment of fine, he shall undergo further imprisonment for six months.
He has further been sentenced to undergo imprisonment for six months for offence under Section 323 RPC. Both the sentences shall, however, run concurrently. The sentence of imprisonment for life, however, shall be subject to confirmation by the High Court.
“Let the execution warrant be issued accordingly. However, the sentences shall not be executed unless the High Court confirms them. Till the confirmation of sentences, accused (convict) be kept in judicial custody”, the order said.
