JAMMU, Jan 6: Additional Sessions Judge Rajouri Kusoom Pandita has awarded life-imprisonment to father and son in murder case.
According to the police case, on 18.02.2014 one Dil Mohd, son of Salah Mohd of Manjidhara and his son Abdul Qayoom shot dead Mohd Sadeeq over a land dispute.
On the basis of investigation, offences under Sections 302/307/326/109 RPC & 3/30 Arms Act were made out against the accused and charge sheet was presented before the court.
After hearing both the sides, the court observed, “while sentencing a convict, the underlying principle to be kept in mind is that showing undue sympathy in favour of the convicts as compared to the societal interests, is not desirable and the appropriate sentence, commensurate the gravity of the act of the offence, should be imposed, which may also serve as a deterrent”.
“In considering the adequacy of the sentence which should neither be too severe nor too lenient, the court has, therefore, to keep in mind the motive and magnitude of offence, the circumstances in which it was committed and the age and character of the offender”, the Judge said, adding “the murder has taken place due to enmity visa-vis land and there is nothing on record to term this murder a case to fall within the definition of rarest of rare cases to warrant capital punishment”.
With these observations, court awarded life imprisonment to Abdul Qayoom, son of Dil Mohd of Manjidhara and imposed fine of Rs 10,000 for commission of offence under Section 302 RPC. The convict was also awarded imprisonment for a period of ten years and fine of Rs 5,000 for commission of offence under Section 307 RPC. He shall also undergo imprisonment of ten years and fine of Rs 5,000 for commission of offence under Section 326 RPC. Further he shall undergo imprisonment of six months for commission of offence under Section 3 Arms Act.
Dil Mohd was also awarded life imprisonment and fine of Rs10,000 for commission of offence under Section 302 RPC. “The convict is also sentenced to imprisonment for a period of ten years and fine of Rs 5,000 for commission of offence under Section 307 RPC and ten years imprisonment for commission of offence under Section 326 RPC”, the court said.
