SRINAGAR, Dec 3: Motor Accident Claims Tribunal Srinagar has recommended registration of FIR for in-depth investigation into the forgery committed by the officials of ARTO Office Poonch in order to mislead the court in a case involving the death of a pedestrian due to rash and negligent driving.
The direction was passed in a petition filed by family members of one Khazir Mohammad Mir, a resident of Laar Ganderbal, who died due to rash and negligent driving of tipper by one Fayaz Ahmad Dar, a resident of Khulmulla, seeking compensation in terms of provisions of Section 166 of the Motor Vehicles Act.
During the course of hearing, it came to the fore that driving license of Fayaz Ahmad Dar was forged by the officials of ARTO Office Poonch in order to mislead the Tribunal for favourable decision.
However, fortunately the process of derailing of administration of justice was saved with the examination of official of the ARTO Office Poonch as witness with regard to deposit of the renewal fee and due to the assistance provided by Advocate Mohammad Ashraf Lone, counsel for the insurance company.
“I am of the considered opinion that a detailed investigation is needed in the present matter. Obviously, this is only possible by registration of a formal FIR. Simultaneously, it is needed that a thorough inquiry is to be conducted in the matter by the higher officers of the Department of Transport”, Presiding Officer MACT Srinagar Subash C Gupta said after hearing Advocate Irfan Hussain Bhat for the petitioners, Advocate M A Lone for the insurance company and Advocate Bashir Akhter for the respondents.
The Presiding Officer directed that the copies of the order shall be sent to the Director General of Police, Inspector General of Police, Jammu and SSP Poonch for necessary action as warranted under law in the light of observations of the Tribunal.
“Simultaneously copies of the order along with relevant record be also sent to the Commissioner Secretary Transport and Transport Commissioner for departmental inquiry in the matter in order to identify the erring officials of ARTO Poonch and taking necessary action against them”, the Presiding Officer further said.
