Man accused of raping nephew’s wife gets anticipatory bail

NEW DELHI, Aug 8:
A 50-year-old man, accused of repeatedly raping his nephew’s wife, has been granted anticipatory bail by a Delhi court.
Additional Sessions Judge Umed Singh Grewal granted anticipatory bail to Anil Kumar, who was accused of raping the complainant and threatening to make her obscene photographs public if she protested.
“Incident of rape is alleged to have taken place on May 23 and was repeated several times. The complainant did not report the matter to the police or the court though she used to visit Rohini court regularly.
“Her husband came out of jail on June 4 but she preferred complaint only on July 6 and FIR was registered on July 15. This huge delay is indigestible,” the court noted while granting anticipatory bail to the accused.
The ASJ considered the submission of Kumar’s counsel K K Sharma that the accused had been falsely implicated at the behest of his nephew (complainant’s husband), who is a habitual offender, and complaint of rape is a fallout of extortion complaint lodged by Kumar against him.
He said the complainant’s husband had been lodged in jail in Muradabad and Tihar in theft cases and also used to deal in trafficking of minor girls. He was threatening Kumar to give him Rs 50,000 or else he would implicate him in a criminal case, the counsel alleged.
Kumar had then made a complaint of extortion against his nephew at Sambhal in Uttar Pradesh. He alleged that the complainant was a woman of low character and runs brothel.
The prosecution opposed the anticipatory bail plea saying even if it is presumed that victim is a woman of easy virtue, it does not give a licence to the accused to rape her.
Considering the submissions made by Kumar’s counsel, the court directed him to be released on anticipatory bail in the event of an arrest on a personal bond of Rs 30,000 and a surety of like amount.
The woman had in her complaint to the police said her husband was facing trial in Rohini court and was lodged in Tihar jail in a case of kidnapping.
She said she used to come to the court on date of hearing and in February, she met Kumar, the maternal uncle of her husband in the court and he promised to provide her a good advocate.
Thereafter, he started accompanying her to the court and on May 23, he gave her a cold drink and consuming it, she started feeling dizzy. Kumar then made her sit in his car and took her to a room where she was raped, the woman alleged.
She was raped by the accused several times, the woman told the police.
She said Kumar threatened her that if she protested, he would make her obscene photographs public and she made a complaint to the police when her husband came out of jail in June. (PTI)
