Man gets life imprisonment for killing aunt

JAMMU, Oct 23: Principal Sessions Judge Reasi Kamlesh Pandit has awarded life imprisonment to Sham Lal for killing his aunt Pushpa Devi, wife of Dewan of Bhagta over a family feud.
After hearing Public Prosecutor RB Bandral for the UT whereas Advocate VK Sharma for the accused, the court observed, “it is a case of murder committed without any grave and sudden provocation. The law stands settled that the sentence of death is to be imposed in what is described as rarest of rare cases”.
“The circumstances of the case do reveal that it was a horrifying murder and victim was much older than the accused and the murder was committed without any grave and sudden provocation”, the court said, adding “the accused person disregarded the noble relation and the case in hand is almost on the boarder of the rarest of the rare cases”.
“The offence of murder itself is a gruesome act but that itself is not sufficient to bracket the convict to be a menace and threat to the harmonious and peaceful coexistence of the society. Thus having regard to the facts and circumstances of the case and age of the convict, the capital punishment is not awarded to the convict”, the court said, adding “the interest of the justice would be sub served in case the convict is sentenced to imprisonment for life”.
Accordingly, court ordered that the convict shall undergo imprisonment for life.
