SRINAGAR, Apr 21: High Court today granted interim bail to Deputy Superintendent of Police who was arrested by Vigilance Organization for allowing unauthorized construction within the peripheries of Dal Lake during his tenure.
Presently posted as DySP Armed Police 13 Battalion Shah Sikander Khan was arrested by Vigilance Organization Jammu on March 14.
Justice Ali Mohammad Magrey after perusal of record of the investigating agency granted the interim bail to the accused till May 1 on the bail bond of Rs 50000 and surety bond of the same amount to the satisfaction of Investigation Officer.
“Record transpires that the investigating authorities have investigated the matter and examination of the accused is also concluded and prima facie, it is made out that the custodial
interrogation of the accused/petitioner is no more required by the IO”, Justice Magrey said while granting bail to accused.
Court on the submissions of State counsel put certain conditions in the bail and directed the accused police official to remain present before the IO during office hours and also as and when asked. “The petitioner/accused shall not leave Srinagar city and shall not influence the evidence or material”, reads the other condition.
Petitioner Khan is involved in three FIRs registered with VO under Section 5(1) d read with Section 5(2) of PC Act and Section 120-B RPC for allowing the construction within the jurisdiction of LAWDA when he was deputed as Enforcement Officer LAWDA during February 2014 to May 2015.
