Medley Pharma files damage suit of Rs 5 cr against Jammu based firm

JAMMU, Apr 26: In a damage suit filed by Mumbai based Pharmaceutical firm namely Medley Pharmaceuticals Ltd through its General Manager (MFG) Jammu against M/s Life Line Pharmaco Surgicals, Additional Sessions for passing a decree against the defendants to pay a sum of Rs 5 crore as damages for causing immense disrepute to the plaintiff’s reputation, Additional Sessions Judge Jammu Sanjay Gupta today issued notice to the Jammu based firms.
According to the suit, the plaintiff learnt through media reports that certain samples of drugs were lifted from Government Hospitals and were declared as ‘Not of Standard Quality’ by the analyst of the Drugs and Food Control Organization.
The plaintiff was shocked to learn that the name of Medley Pharmaceuticals Litd figured in a series of newspaper reports mentioning that a drug named Maximizin 625 (Amoxicillin Trihydrate and Potassium Clavunate) Batch No. PBT 1583 was allegedly manufactured by plaintiff and supplied by the defendants.
“By using the name and brand of the plaintiff, the defendants have breached the civil rights, patent rights, copyrights, name and hard earned reputation of the plaintiff. For reaping rich dividends the defendants have illegally caused immense loss of reputation to the plaintiff by their unlawful and illegal means and methods”, the suit said, adding “the cause of action has accrued to the plaintiff on 20th April 2013 when the Government issued a press statement disclosing that the defendants had used the forged documents and name and brand of the plaintiff to supply the spurious drugs”.
After hearing Advocate A K Sawhney with Advocate Aseeem Sawhney, the Additional Sessions Judge issued notice to defendants with the direction to list the case on May 25, 2013.
