SRINAGAR, June 11: A local court today issued non-bailable arrest warrants against separatist leaders including Syed Ali Shah Geelani in a 29- year old case.
Court of Additional District and Sessions Judge TADA/POTA, S K Bhagat in its order said: “Let Syed Ali Shah Geelani and Nayeem Ahmad Khan be called afresh through non-bailable warrants which shall be executed through SSP Srinagar”.
However, Court said that in case Geelani is seriously ill and cannot be produced, a medical certificate be produced in this regard positively while citing the grounds because of which earlier non-bailable warrant against Geelani was not executed.
The Court granted bail to JKLF chairman Mohammad Yaseen Malik in the case. “Accused Mohammad Yaseen Malik has been produced in custody who produced bail bonds and surety bonds to the satisfaction of this court. He further undertakes to cause appearance on each and every day henceforth fixed in this case,” the court said.
Malik was arrested on June 4 by police in a case (FIR 23 July FIR no 654 / 1987) in which 23 names including Sayed Ali Shah Geelani and Nayeem Ahmad Khan figure as accused. Malik was also granted bail in other two cases that were registered against him at Police Station Shaheed Ganj in 1987.
The court, however, deleted six names from the accused list as they have already passed away. They are then MUF leader Qazi Nissar Ahmad, People’s Conference leader Abdul Gani Lone, former Chief Minister Ghulam Mohammad Shah, Ghulam Rasool Wani, Hakeem Ghulam Rasool and Mukhtar Ahmad Khan.
Accepting their applications, the court exempted Mushtaq Ahmad Bhat alias Mushtaqul Islam and Bashir Ahmad Mir from personal appearance for today.
Seeking presence of other accused who were not present, the court issued non bailable warrants against them.
For absconding, the court initiated proceedings under Section 512 of CrPC against six accused – Nazir Ahmad Bandey, Irshad Ahmad, Mohammad Rafiq Dar, Abdul Rehman Bhat, Shakeel Ahmad Wani and Imtiyaz Ahmad Bhat.
