JAMMU, Dec 1: Special Judge NIA Sunit Gupta today framed charges under Section 17 of Unlawful Activities Prevention Act and 489-B/489-C RPC against alleged ISI agents namely Ashok Kumar, son of Raseela Ram of Barmeen Ramnagar and Bilal Ahmed, son of Abdul Rehman of Baramulla, who were nabbed with fake currency notes in the year 2014.
After hearing APP Anil Magotra for the Police, Special Judge NIA observed, “though from the perusal of the file, it reveals that the IO in the present case has not complied with the rules in strict terms yet the connection of the accused persons with the terrorists of enemy country have been prima facie established from the articles which were seized from their possession including a bag which depicts the name of ISI organization”.
“Therefore, despite the non compliance of the Rules by the concerned police in the present case, the accused persons cannot be allowed to be scot-free from the offence under Section 17 of UA(P) Act which is found to be prima facie made out against the accused persons”, the court said.
