Non-adherence to court orders will lead to anarchy in society: HC

JAMMU, Dec 11: High Court today said that failure to implement the orders of the courts will lead to anarchy in the society and every citizen/individual is duty bound to respect and obey the orders.
These observations were made by Justice Muzaffar Hussain Attar in a writ petition filed by Mohd Din, son of Rustam Ali of village Lodhra in Ramnagar tehsil of Udhampur district seeking implementation of the orders of the CJM Udhampur in a civil suit pertaining to dispute over religious place at Basantgarh.
“Ours is a country governed by the rule of law. Constitution of India provides protection to all the people who live in this country. Article 14 provides equality before law and equal protection of laws”, Justice Muzaffar Hussain Attar said, adding “Article 14 is the soul of the Constitution and it does not discriminate between the people on the basis of their faith, religion, caste or creed. Article 14, in fact, is unifying factor amongst the people belonging to different faiths, religions, castes and creeds. This Article guarantees unity and integrity of this country”.
He further observed, “in our Constitutional Scheme, the courts have been created for resolving the disputes between the parties. The orders of the court, until such time they are vacated or modified, have to be implemented otherwise, there will be anarchy in the society. Every citizen/individual is duty bound to respect and obey the court orders”.
With these observations, High Court directed Deputy Commissioner Udhampur, Senior Superintendent of Police Udhampur, Tehsildar Udhampur, SDPO Ramnagar and SHO Basantgarh to implement the orders of (Sub-Judge) CJM Udhampur dated August, 12, 2014 and ensure that rights of the parties are protected in terms of the civil court order whereby directions were issued to both the parties to maintain status quo on spot with regard to the suit land covered by Khasra No.1078/164 situated at village Basantgarh (Ramnagar).
Advocate Sheikh Shakeel Ahmed with Advocate Ayjaz Lone appeared for the petitioner and Advocate Arjun Singh Pathania appeared for the inhabitants of Basantgarh.
