Non-bailable warrants issued against SHO

JAMMU, Nov 21: Principal Sessions Judge Samba Kartar Singh has issued non-bailable warrants against Investigating Officer in a murder case namely KD Bhagat, presently posted as SHO Nowshera, to secure his presence in the Court on the next date of hearing.
According to the police case on July 4, 2007, the accused Chander Kant armed with a knife entered in the house of deceased Rachpal and inflicted numerous injuries on the deceased with the intention to kill him. On hearing the cries of the deceased, large number of people gathered on the spot. However, the accused managed to escape from the spot by threatening to blow up the LPG cylinder.
During the course of investigation, it came to fore that accused Chander Kant, who belonged to Scheduled Caste family, was in love with Geeta Devi, who was from a higher caste. Her father and other Biradari members were against the marriage. The accused Chander Kant had eloped with her and a case under Section 363 RPC was registered against him.
Rajinder, uncle of Chander Kant was aware of whereabouts of accused but was not disclosing the same to complainant party and this led to scuffle between Rajinder and Rachpal a number of times. Rajinder had remarked in the public that scuffles would cost Rachpal heavily.
During the course of hearing, Public Prosecutor submitted before the Court that SHO was summoned through wireless message but he was not turning up intentionally and deliberately.
“The conduct of the investigating officer is quite reprehensible and it appears that his presence can not be secured through ordinary mode”, the Court observed and issued non-bailable warrant to be executed through SSP Rajouri with the directions that the investigating officer be produced in the court on the next date of hearing.
“The accused is an under trial and is facing trial for the last five years. The case is lingering on for want of evidence of SHO, who is intentionally and deliberately avoiding the service of the court”, the Court said.
