Notice for cancellation of allotments

JAMMU, May 30: State Government has issued show-cause notices for cancellation of allotment of 30 shops and halls at Bahu Plaza.
This was revealed by the Commissioner Secretary, Housing and Urban Development Department in the status report filed in the High Court in pursuance to the earlier directions of the court.
On May 1, 2012, the High Court had directed the Commissioner Secretary, Housing to file a fresh status report with regard to the affidavit filed by the Commissioner Secretary, General Administration Department mentioning that on April 12, 2012, State Government issued directions to the Housing and Urban Development Department to put the allottees of halls and shops to notice, seek their objections and thereafter pass appropriate orders with a view to restore the properties to JDA.
In the status report filed through AAG Gagan Basotra, it has been submitted that the Housing and Urban Development Department has already issued show cause notices seeking cancellation of all the 30 allotments excluding of Shamsher Singh, son of Nanak Singh of Gandhi Nagar, whose allotment has already been cancelled by the respondents and is presently challenged before the High Court.
“The show cause notices were issued on May 18, 2012 with the directions to the allottees to respond within 21 days”, the report said.
The status report has been filed in a petition filed by Sunil Mahajan through Advocate Sheikh Shakeel Ahmed challenging the allotment of Hall No 209 South Block Bahu Plaza in favour of Sajjad Ahmed Bhat on the ground that no procedure was followed while making the allotment.
In the meanwhile, Advocate I H Bhat filed objections on behalf of Sajjad Ahmed Bhat, who had been given last opportunity to file his response to the petition.
All these 31 allotments had earlier been cancelled by then Chief Minister and presently Union Health Minister, Ghulam Nabi Azad, which became the subject matter of challenge in the batch of petitions. Accordingly, these petitions were allowed for non-compliance of the procedure laid down in Section 37 of Development Act.
