One discharged in death case

JAMMU, Aug 5: 2nd Additional Sessions Judge Jammu, M K Sharma today discharged Janmeet Singh and framed charges under Section 304-A instead of 304 against Akshit Ganjoo and Romesh Chander, who were facing charges in the much publicized death case of foster son of Farooq Khan.
After hearing both the sides, 2nd Additional Sessions Judge observed, “the offences disclosed against Akshit Ganjoo and Romesh Chander are punishable under Sections 279/337/427/304-A/34 RPC and 112/184 MV Act, whereas, offences under Sections 304/118/203 RPC are not disclosed”.
“The ingredients of offence under Section 336 RPC are covered u/s 337 RPC, so, the offence under Section 336 RPC has merged into Section 337 RPC. Akshit Ganjoo and Romesh Chander are accordingly discharged of offences punishable under Section 304/336/118/203 RPC, whereas Janmeet Singh is discharged of all the offences of which he is charged”, the court said.
“The offences disclosed against Akshit Ganjoo and Romesh Chander are not exclusively triable by the court of Sessions Judge. The case is, therefore, transferred to the court of CJM for trial in accordance with the procedure for trial of warrant cases instituted on police report”, the court said.
