Srinagar, Nov 28: A court in north Kashmir’s Uri today sentenced a man to 2 years and 9 months in prison, along with a fine, for reckless and unlicensed driving that killed six people in the Thajal area a decade ago.
The court found the accused, Naseer Ahmad Kaali of Balakote, Uri in district Baramulla, guilty under Sections 279, 337, 338, and 304-A of the RPC and Sections 3/181 and 113/194 of the M.V. Act.
The judgment, pronounced by Fozia Paul, Judicial Magistrate First Class, Uri, highlighted eyewitness accounts that vividly described the rash and negligent driving of the accused and detailed the circumstances that led to the accident.
“Accordingly, I convict the accused of the offences,” the Magistrate stated, adding, “granting probation in this case would be tantamount to a license to kill, making the roads a roulette of death.”
The court noted that the prosecution had proven the contents of the seizure memo. “…it is revealed that all the eyewitnesses have avowed that the accused was driving the vehicle rashly and negligently on a dangerous and rough road,” the court stated.
As per the court, the accused was sentenced to simple imprisonment for two years and fined Rs 5,000 for the offence under Section 304-A of the RPC; simple imprisonment for one month and a fine of Rs 1,000 under Section 279 of the RPC; and simple imprisonment for one month under Section 337 of the RPC.
Additionally, a simple imprisonment of six months and a fine of Rs 1,000 under Section 338 of the RPC was announced, along with one month under Section 3/181 of the M.V. Act and a fine of Rs 2,000 under Section 113/194 of the M.V. Act.
