Patwari acquitted as complainant refutes version

JAMMU, Nov 30: Special Judge Anticorruption Jammu A K Koul today acquitted Shahnaz Ahmad, Patwari Halqa Shiba, who was challaned by the Vigilance Organization for demanding bribe of Rs 5000 from the complainant, as complainant refuted his earlier version.
While acquitting the Patwari, court took serious note of complainant making mockery of the process of law. “It is necessary to put on record that the complainant Sunny Sharma has made a mockery of the process of law. He has set the process of law in motion through his written complaint dated 21.07.2008, whereby he demanded action against the accused on the count that he committed misconduct”, the court said.
“Vigilance Organization conducted a detailed investigation and finally submitted the charge sheet in the court on 06.06.2009. The judicial process continued for more than six years and ultimately the case failed mainly because the complainant refuted his earlier version”, the court said, adding “the complainant has committed the offence of perjury. The complainant has mocked the entire system for some unknown gain”.
“The Vigilance Organization as well as this court have wasted more than seven years in concluding a matter, which the complainant had for all purposes, initiated either simply with the intention to harm the accused unnecessarily or he gave false evidence in court to save the accused”, Special Judge Anti-corruption said, adding “in either case he has intentionally fabricated false evidence for the purpose of being used in judicial proceedings or has given false evidence during the proceedings of this case. It is high time that such witnesses are dealt with severely in order to eradicate the evil of perjury”.
“The complainant should be prosecuted for the offence(s) which he appears to have committed but before doing so court deem it necessary to afford an opportunity of being heard to him. Separate proceedings be initiated against him and in the first instance he shall be put on notice to show cause as to why he shall not be prosecuted for commission of offence under Sections 182/ 191 read with 193 RPC”, Special Judge Anti-corruption said, adding “the next course will follow only after the complainant submits his explanation”.
