JAMMU, Nov 16: The J&K Pradesh Congress Committee (JKPCC) has said that keeping the State Assembly in suspended animation beyond a reasonable period would be unjustified and amount to keeping the flood gates for horse trading open.
Reacting to the statement of the Governor, SP Malik in this context, PCC has said that keeping the State Assembly in suspended animation beyond a reasonable period is quite unjustified and also against the basic spirit of the constitutional provision in this regard, as it amounts to keeping the flood gates for horse trading open, especially when there is hardly any scope for any alternative formation of the Government through genuine democratic and constitutional norms, in the state.
JKPCC chief spokesperson Ravinder Sharma said that a democratic Government is dissolved and assembly placed under suspended animation following failure of constitutional machinery and the Government rule is imposed for a period of first six months followed by President’s rule.
The ruling coalition (PDP-BJP in the present case) too, has lost the mandate to rule anymore because they failed to run the state as per requirement of the constitution as a result, Governor rule had to be imposed in the State. It can’t be wish and convenience of any such formation to fall apart and come together in any form at their will, making mockery of the people in the democracy. The constitutional authority has to come to a conclusion within a reasonable time limit after exploring the possibilities, if any, through genuine democratic and constitutional modes, otherwise, take next step to dissolve the Assembly, to send a clear signal and create conducive atmosphere for holding of fresh elections, at an appropriate time.
He said that an atmosphere of uncertainty and confusion on this issue should not be allowed to continue for all times to come till the expiry of the present term of Assembly and a decision has to be taken within reasonable time limit, about the fate of the Assembly, he said.
