JAMMU, July 15: A delegation of workmen of Forest Development Corporation led by Suresh Sharma of People’s Welfare Civil Society called on Additional Commissioner, Addl Provident Commissioner (JKUT) and Labour Commissioner Jammu to bring into various anomalies in the accounts bonafide CPF subscribers.
The delegation discussed various issues pertaining to workers class. They pointed out that employees are not properly credited interest accrued on account of subscriptions of interest on such contributions throughout country prior to 2019. Let CPF commissioner clearly show year wise rate of interest credited. He said CPF has calculated interest up to February 2021. But deposited with Central EPFO i.e on February 17, 2022. In spite of our long drawn meetings for the last 10 months at last Addl Provident Commissioner J&K was convinced and admitted that it is to be paid by central EPFO and conveyed the same to central EPFO vide No.Addl./PFC/J/267 Dt. 12/6/2023, but still no action taken, Sharma regretted.
It was requested to credit and release the interest accordingly without any further loss of time. He said the deduction of TDS at the time of withdrawal is being made by central EPFO illegally and on flimsy grounds when there is statutory Income Tax Act that any subscriber who had continuously contributed for more than five years he or she is not liable for deduction at source. He explained that 99 % of SFC employees are recruited between 1980s to 1990s. Thus each employee is subscriber for more than five years and liable TDS exemption.
It is irony rather hypothetical reasoning for EPFO to stick to Nov, 2019 as joining date of each employee and is illegally deducting 10% TDS on retirement. He said issue of F-16 to all employees who have withdrawn fund and TDS deducted with clear mention that subscription is more than five years of time so as to claim unhindered refund.
