Prosecution failure leads to acquittal of 2 alleged militants

JAMMU, Sept 23: 1st Additional Sessions Judge Jammu M A Chowdhary has acquitted two alleged ISI militants namely Muzafar Ilahi and Ilam Din, both the residents of Kishtwar as prosecution miserably failed to prove the case.
These militants were arrested from a camp near Vaishnavi Dham, Railway Station on December 21, 2008 along with arms and ammunition besides hawala money.
After hearing APP Ajay Singh Manhas appearing for the State whereas Advocates Vikar Hussain Salaria and Yogesh Bakshi appearing for the accused persons, court observed, “prosecution has not cited or examined any ballistic expert  who could be the only witness to say whether  the seized weapon and ammunition was in working condition or not”.
“In absence of such proof, offence under Arms Act could not be said to have been proved against the accused”, the court said, adding “prosecution has failed to connect the accused with the commission of offence by leading sufficient, cogent and credible evidence”.
Stating that prosecution has failed to bring home the charge against the accused, the court acquitted the accused of the charge.
