Prosecution failure leads to acquittal in attempt to murder case

JAMMU, Apr 30: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted Mohd Javed Khan, son of Mohd Fazal Khan, Mohd Showket, son of Hafiz Ullah, Mohd Rashied, son of Hafiz Ullah and Abdul Rashied, son of Ahmed Din, who were facing trial in attempt to murder case for the last eight years due to the failure of the prosecution to prove the case.
After hearing both the sides, Principal Sessions Judge Poonch observed, “ prosecution had serious animus against the accused and the independent witnesses have not supported the prosecution version at all”, adding “it will be very difficult to rely upon the sole testimony of one of the prosecution witness. The result is that the prosecution story is doubtful as such the benefit of doubt should go to Mohd Javed Khan, Mohd Showket, Mohd Rashied and Abdul Rashied”.
Accordingly, they were acquitted. The court also issued General Arrest Warrants against Waqar Younis, son of Mohd Misree.
