Prosecution failure leads to acquittal of accused in forgery case

JAMMU, June 25: Principal Sessions Judge Jammu, Kartar Singh has acquitted one Mohan Lal Gupta of the charges of forging documents of property of Ladies Cooperative Housing Building Society Jammu as the prosecution miserably failed to prove the case.
The case against Mohan Lal Gupta was registered on the basis of a formal complaint of President of Jammu Ladies Cooperative Housing Building Society.
During investigation, it was found that the signatures of the complainant were forged on the lease deed. After investigation, the final report was submitted in the court of law.
After hearing Advocate Rupak Ratta for the accused whereas Public Prosecutor for the State, Principal Sessions Judge observed, “the prosecution has failed to give an explanation as to why the material aspects have been ignored by the investigating officer”.
“The investigating officer was the competent person to explain all these circumstances surfacing during investigation but he has not been examined. His non-examination has caused serious dent to the prosecution story”, the Court said.
Holding that the prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt, the court acquitted the accused of the charges leveled against him.
