Prosecution failure leads to acquittal of HM militant

JAMMU, May 11: Principal Sessions Judge Jammu, Kartar Singh has acquitted alleged militant of Hizbul Mujahidin namely Farid Ahmed, son of Mohd Sharief  Khanji of Goela, Thathri, as prosecution witnesses didn’t support the police case.
The alleged militant was arrested on December 15, 2010 and from his possession passport issued by Pakistan, one identity card issued by Forward Sports Pvt. Ltd Wazirabad, Sialkot and three SIM cards were recovered.
During investigation, it was found that on August 6, 2001 Farid went to Pakistan where he worked with Hizbul Mujahidin  for ten years before entering India via Nepal.
After hearing both the sides, Principal Sessions Judge observed, “not even a single witness has supported the prosecution story. It is the case of the prosecution that on the arrest of the accused, identity card and a passport issued by Pakistan were recovered from his possession. However, Mohd Sharif and Zaffer Ullah, the attesting witnesses of the seizure memo, have not supported the prosecution story and categorically stated that nothing was recovered from the accused in their presence”.
“The other two eye witnesses of the seizure memo are police personnel and they have not been examined by the prosecution for the reasons best known to it. Since there is no incriminating evidence against the accused, he is, therefore acquitted of the charges leveled against him”, the Court said.
