Prosecution failure leads to acquittal of murder accused

JAMMU, June 25: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today acquitted Vikram Singh alias Vicky, son of Amar Singh of Nagrota and Ashok Kumar Chouhan, son of Bishambar Dayal Chouhan of Rewari Haryana of the charges of committing murder of Dilbar Singh as prosecution miserably failed to establish its case against the accused beyond any shadow of doubt.
According to the police case, on September 6, 2006 one Satinder Singh lodged missing report of his real brother Dilbar Singh with Nagrota Police. He informed the police that his brother was having friendship with a girl, who was earlier having relations with Vikram Singh and Ashok Chouhan. The complainant also expressed apprehension about Vikram and Ashok Chouhan having killed his brother.
Accordingly, police registered a case and started investigation. After completion of investigation challan was presented in the court of law.
After hearing both sides, Principal Sessions Judge observed, “taking into the account the statement of prosecution witnesses, the Court is satisfied that prosecution has not been able to establish the case where the guilt of the accused can be drawn and justified. All the circumstances are not found to be incompatible with guilt of the accused”.
“All the evidences as well as the circumstances have been evaluated. The evidences tendered at the trial are not reasonably capable to draw inferences in favour of the prosecution and cannot prove the guilt of the accused”, the Court said, adding “the circumstance on which the prosecution relied upon has not been fully established. There are lot of links missing in the prosecution evidence”.
“The deceased last seen with the accused has also not been proved”, the Court further observed, adding “the court is satisfied that prosecution has miserably failed to establish the case against the accused beyond any shadow of doubt”.
With these observations, the Court acquitted the accused of the charges framed against them.
