Prosecution failure leads to acquittal of murder accused

JAMMU, Mar 19: Principal Sessions Judge Kathua, M K Hanjura has acquitted one Subash Chander, who was facing trial for allegedly committing the murder of one Sagar Chand as the prosecution failed to connect the accused with the crime.
According to the police case, on June 27, 2010 the accused namely Subash Chander, son of Mangoo Ram of Sounthal Kathua obliterated the boundary of the land of Sagar chand, son of Golu Ram and inflicted a blow with an iron rod on Sagar Chand’s back as a consequence of which the latter sustained serious injuries. He was shifted to District Hospital Kathua where he succumbed to the injuries.
After hearing Public Prosecutor Ravi Kumar Gupta for the State whereas Advocates Adarsh Sharma and TN Gupta for the accused persons, Principal Sessions Judge Kathua, M K Hanjura observed, “the prosecution case is doubtful as the Medical Officer has stated that injuries sustained by the deceased could not be possible by a single blow. He has proceeded to state that the blow might have been given to the deceased on his chest”.
“The medical opinion is not in tune with the prosecution case and there is no reliable evidence on record that could be considered by the Court for holding that the prosecution has succeeded in bringing the guilt of the accused”, the Court said and acquitted the accused of the charges leveled against him.
