Prosecution failure leads to acquittal of murder accused

JAMMU, May 25: Principal Sessions Judge Reasi, Rajesh Sekri has acquitted Parveen Akhter, Zaman Shah and Mohd Shafi, who were facing trial in a murder case as prosecution failed to prove its case.
According to the police case, on October 9, 2010 Mahore Police received information that Wasima Akhter, wife of Mohd Rafi was shot dead by somebody and her body was lying in house of Zaman Shah.
On this information, police registered a case and during the investigation it came to light that accused Parveen Akhter and the deceased Wasima Akhter were quarreling for the last 2/3 months as the husband of the deceased Mohd Shafi wanted to contract second marriage. On October 9, 2010 accused persons shot dead Wasima Akhter. After completion of investigation police presented challan in the court.
After hearing PP for the State whereas Advocate Sheikh Altaf for the accused persons, Principal Sessions Judge observed, “failure on the part of prosecution to prove the memo of seizure of the weapon of the offence and the FSL expert to prove the finger prints on the weapon of offence proves fatal. The prosecution has badly failed to prove the guilt of the accused beyond reasonable doubt”.
With these observations, the Court acquitted the accused by giving them benefit of doubt.
