Prosecution failure leads to acquittal of Pak national in massacre case

JAMMU, Oct 18: In the much-publicized 2002 Rajiv Nagar massacre which left 29 dead and 30 injured, Principal Sessions Judge Samba MK Sharma has acquitted Mohd Abdullah, son of Hassan Baksh of Multan, Pakistan as prosecution miserably failed to establish charge against the accused.
On July 13, 2002, some militants entered Rajiv Nagar area, lobbed hand grenades and resorted to indiscriminate firing leading to the death of 29 persons and injuries to about 30 others.
After hearing Public Prosecutor BS Charak for the State whereas Advocate Ganesh Sharma for the accused person, the court observed, “the prosecution has miserably failed to establish charge against the accused”, adding “the only available course, therefore, is to discard the anaemic evidence and acquit the accused”.
Accordingly, court acquitted the accused of the charge. “The seized arms and ammunition shall be released in favour of the State after the expiry of period of appeal. Since, the accused is a Pakistan national so the State is directed to take steps for deportation of the accused to his native country”, the court said.
