Prosecution failure leads to acquittals in dowry death case

JAMMU, July 27: Principal Sessions Judge Jammu, Kartar Singh today acquitted Raj Rani, wife of Bal Krishan and Ashok Kumar, son of Bal Krishan, residents of Upper Mast Garh, who were facing trial in dowry death case for the last nine years, as the prosecution failed to prove the case.
According to the police case, on May 28, 2004 Police Post Chowk Chabutra received a telephonic message from Police Post Government Medical College Hospital, Jammu informing that one Neena Kumari, wife of Ashok Kumar had suffered burn injury and was admitted in the Emergency Ward of the hospital.
On this, police went to the hospital and recorded the statement of the victim, who deposed that her husband, mother-in-law and father-in-law had been harassing her since long and wanted to turn her out of her matrimonial house.
On May 28, 2004, when she was preparing meal in the kitchen her mother-in-law poured kerosene oil upon her and set her ablaze. Though she was immediately rushed to hospital yet later he succumbed to injuries.
After hearing both the sides and going through the statements of prosecution witness, Principal Sessions Judge held, “prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt as such they are acquitted of the charges framed against them”.
